The first revelation of secrets was from Miguel Ángel Rodríguez: emails to various media before the denial of the Prosecutor’s Office

He confession mail of Alberto González Amador, Ayuso’s partner, in which he admitted two tax crimes, and for whose dissemination has been charged the State Attorney General, was not the first communication between the commission agent’s lawyers and the public ministry that appeared published in the press. Hours before Cadena Ser broadcast the email that showed that the conformity agreement had come from González Amador’s defense, Miguel Ángel Rodríguez, Díaz Ayuso’s chief of staff, sent messages from his personal phone to different media with another of the emails exchanged by the prosecutor in the case, Julián Salto, and the commission agent’s defense. Rodríguez sent the message first to an El Mundo journalist and then forwarded via WhatsApp to other media outlets such as Libertad Digital, El Debate and Vozpópuli.

The text sent by the Madrid president’s chief of staff on the night of March 13, one day after elDiario.es uncover tax fraud by González Amador, is headed like this: “Look at the reality of the email that Mr. González’s lawyer receives.” Next, Rodríguez goes on to reproduce the email that the prosecutor in the case Julián Salto sent on March 12, 2024 to González Amador’s defense. And finally Rodríguez tries to show that it is the prosecutor in the case who proposed an agreement in accordance with the commission agent’s defense and that it is the prosecutor himself who withdraws the agreement by “orders from above.” “Everything dirty,” Rodríguez’s message ends.

The WhatsApp that Rodríguez sent to various media with part of the conversation between the defense of Ayuso’s partner and the prosecutor who reported him for fraud to the Treasury.

The first media to publish this unverified message is the newspaper El Mundo, which in its first information headlines: ‘The Prosecutor’s Office offers Ayuso’s partner an agreement to admit two tax crimes.’ In the subtitle of that first news it said: “He launched his proposal to Alberto González two hours after the case broke out.”

This is false information, which hid that the offer of the agreement to plead guilty had been sent by the defense of Ayuso’s partner to the prosecutor and not the other way around. And that he had done it on February 2, 2024, five weeks before the publication of elDiario.es, not two hours later.

As soon as that news was published, Miguel Ángel Rodríguez published a tweet blaming the leadership of the Prosecutor’s Office for stopping that agreement.

Other newspapers such as Libertad Digital, El Debate and Vozpópuli included in the headline not only that the agreement had come from the prosecutor but also that it had been withdrawn “by orders from above”, as Ayuso’s Chief of Staff had sent them and without any contrast.

All this false information was what motivated a press release from the Prosecutor’s Office that, after collecting all the information, detailed the chronology of the case with the dates and steps that the Public Ministry has been taking. As a result of that statement, Ayuso’s partner and the Madrid Bar Association filed complaints for revealing secrets. They argued that the account of events published by the Public Ministry was detrimental to the right of defense, a thesis endorsed by the Superior Court of Justice of Madrid, which sent a reasoned statement to the Supreme Court to investigate the attorney general, Álvaro García. Ortiz, who from the beginning was responsible for the press release.

The Supreme opened an investigation against the attorney general this Wednesday, but not because of the press release, but to investigate whether it was the state attorney general who leaked the email in which González Amador assumed his guilt and which was published in the early hours of March 13, first by Cadena Ser and, later, other media, including elDiario.es.

The email was forwarded on February 2, 2024, five weeks before the first publication of elDiario.es, to a generic address of the Madrid Prosecutor’s Office to which 18 people, 14 prosecutors and four officials, have access. The lawyers of Ayuso’s couple tried to seek a compromise by agreeing to an eight-month sentence and the payment of the 350,000 euros defrauded plus the fine and interest, in exchange for the sentence not entailing imprisonment and avoiding a trial for in which experts, front men and Treasury technicians paraded.

That email was the one that opened the negotiation between González Amador’s lawyers and the prosecutor in the case, but not the first that was published in the media. The first communication that came to light was the response of the prosecutor in the case to that offer that El Mundo, Miguel Ángel Rodríguez and other media outlets to which it was leaked presented as proof that the Prosecutor’s Office was proposing an agreement to Ayuso’s partner. just two hours after elDiario.es uncovered his fraud. A false information.

In the conservative press the hoax had different degrees. The first media to publish it, El Mundo, only assumed, as did Miguel Ángel Rodríguez, that the offer had come from the Prosecutor’s Office. Libertad Digital, El Debate and Vozpópuli went further and also assumed the story of Ayuso’s Chief of Staff who stated that the pact was stopped by “orders from above.”

Instructions that did not exist, according to the sources consulted by elDiario.es, who recall that the Public Ministry and González Amador have already reached an agreement for Ayuso’s partner to assume two crimes of tax fraud, one of document falsification and the well-known prison sentence, in addition to payment of the fine. This agreement could not be ratified at the moment before the judge because the popular accusations made by Más Madrid and PSOE have requested that the investigation be expanded to Ayuso’s partner for other crimes related to their links with the Quirón health group, one of the main contractors. of the Community of Madrid and whose director Fernando Camino was key in the two million commission that González Amador charged for selling masks.

If it were not for this expansion of crimes proposed by PSOE and Más Madrid, the conviction for these three crimes would already have been ratified in court. Despite this, the leaker of the first email and promoter of false information, Miguel Ángel Rodríguez, has insisted on his hoax this Thursday, after admitting that he himself leaked the email.

Unlike the State Attorney General, Ayuso’s Chief of Staff is not under investigation, since no one has denounced him for revealing secrets. The only injured party with the capacity to do so, in addition to Ayuso’s partner, is the prosecutor in the case, whose email was spread and manipulated by Díaz Ayuso’s ‘right hand’.
