Mexico City.- Amid claims from the opposition, Morena and allies in the Senate approved the call for the election of judges in 2025.
The call to integrate the lists of candidates who will participate in the extraordinary election was approved with 78 votes in favor and 39 against.
Upon completion of this step in the judicial reform, PT Gerardo Fernández Noroña, president of the Senate, described this decision as historic, since no country elects all of its judges. “It is a historic call, no country in the world elects all its judges and from Mexico a new path is opened for humanity in the democratization of the judicial power of nations.
“Congratulations, senators for such an important and relevant determination (…) be published in the Parliamentary Gazette of the Senate, in a newspaper of national circulation, in the Official Gazette of the Federation, with its respective annexes, and in one of the most honorable pages of our country,” he launched, before decreeing the closure of the session.
Yesterday, in the Chamber of Deputies, the changes to the Electoral Procedures Law and the Law of Means of Challenge were approved, this in order to have the rules before the Senate issued the call for the judicial election. According to the call, the candidacy registration stage contemplates in the first instance the installation of the Evaluation Committees by each Constitutional Power. Subsequently, the reception of documents for registration, the evaluation of the candidates for the performance of the position, the selection of the best evaluated people, the insaculation process, the generation of the final lists, their submission to the INE and finally the publication of the results. The call that the Senate will issue establishes that the Powers of the Union – Executive, Judicial and Legislative – will install their respective Evaluation Committees no later than October 31. The Evaluation Committees are the bodies in charge of publishing the calls to participate in the evaluation and selection process of applications no later than November 4. One of the transitional provisions establishes that the Executive will be requested – through the Treasury and Public Credit – to assign in the Expenditure Budget “the complementary item for the INE to carry out the organization and development of the electoral process”; The Powers of the Union must also provide “the necessary resources” for the Evaluation Committees to initiate and develop the tasks that the Call assigns and places to them. It is also requested that the Executive Branch, the Specialized Prosecutor for Electoral Crimes and the INE “take care that the campaign process of the candidates for the various positions takes place safely and without interference from any institution or agent that could affect impartiality, fairness of competition and the exercise of political-electoral rights”. The period for interested persons to register for the calls issued by the Evaluation Committees will be from November 5 to November 24. And they will publish the list of eligible people no later than January 31, 2025. After this, the Evaluation Committees will refine said list through a public insulation to adjust the candidacies to the number of applications for each position for each Power according to the specialty by subject and taking into account gender parity. The approved lists will be sent to the Senate of the Republic no later than February 8, 2025 and will integrate the files of the candidates to send them to the INE no later than February 12, 2025 to organize the elective process towards election day. .
Positions to choose
-Five ministers and four ministers of the SCJN.
-Three magistrates and 2 magistrates of the Judicial Disciplinary Court. -A magistrate and a magistrate from the Superior Chamber of the TEPJF. -Ten judges and 5 judges from the regional chambers of the TEPJF. -The 464 positions for magistrates of collegiate circuit courts and collegiate appeal courts -The 386 positions for District judges.
