a question
A question came from a reader in which she said:
I am a divorced woman, and I have been blessed with four children by my husband, and I received custody of my three daughters. While custody of the boy remained with my ex-husband, but he prevented me from seeing him and sent him to our country, to live with his grandfather, without care from me or from him, and my question is, do I have the right to file a lawsuit? The issue of dropping custody from him? Note that he is my ex-husband and works and resides in the country.
Answer
Legal Advisor Dr. Youssef Al-Sharif answers:
The mother has the right to request that custody be dropped from the father as long as he prevents her from seeing the child by deporting him and leaving him in his home country, as this is considered a relinquishment of custody to others in violation of the ruling. If a ruling is issued, he must bring the child. Otherwise, you can file a criminal report for his refusal to hand over the child to whomever has the right. In his receipt and custody in accordance with the text of Article 380 of the Code of Crimes and Penalties, the penalty for this crime is imprisonment or a fine (imprisonment without a minimum or maximum, and a fine as well).
