Minister Cristiano Zanin was the only one among the members of the Federal Supreme Court (STF) to honor the inauguration of the new management of the Superior Labor Court (TST) – in addition to the president of the Supreme Court, Luís Roberto Barroso, and the president of the Superior Electoral Court (TSE), Cármen Lúcia, who make up the table of honor.
The absence of the other ministers contrasts with President Herman Benjamin’s inauguration ceremony at the Superior Court of Justice (STJ), in August. On the occasion, the 11 Supreme Court ministers attended.
Also present is retired minister Marco Aurélio Mello, who was part of the TST before going to the Supreme Court. The last minister of Labor Justice at the Supreme Court was Rosa Weber, now retired. In the current composition, there are none.
The Supreme Court’s lack of prestige for the TST occurs at a time of divergence between the courts. At the Supreme Court, Minister Gilmar Mendes is the main spokesperson for criticism and has defended the reduction of this branch of the Judiciary.
The focus of the disagreement revolves around the competence to evaluate outsourcing issues. While the specialized courts have seen fraud in legal entity (PJ) contracts and recognized employment relationships in these cases, the Supreme Court has overturned the decisions of labor judges.
From the first echelon of the government, ministers Luiz Marinho, from Labor, and Jorge Messias, from the Attorney General’s Office (AGU), are present. The number 2 of the Ministry of Justice, Manoel Carlos de Almeida, also attended.
