The Federal Judiciary Council (CJF) resolved, by majority vote, to ignore the protections that ordered it to stop compliance with the judicial reform promoted by Q4.
Minister Norma Piña, president of the Court, voted against, but was defeated.
The body also agreed to deliver the lists of judges to the Senate, so that it can call the election of Judges and Magistrates in 2025. By 4 votes to 3, the councilors resolved yesterday in a long session not to attend to the precautionary measures issued by the Judges. of district, in which it was ordered to momentarily freeze the acts that the CJF must carry out, established in the judicial reform.
The CJF is the highest body in charge of the administration, surveillance and discipline of the entire Judicial Branch of the Federation.
The councilors who voted not to stop the reform were Sergio Javier Molina Martínez, Bernardo Bátiz, Verónica De Gyvés Zárate and Celia Maya García, supporters of Morena. Those who resisted and voted against were Minister Piña, José Alfonso Montalvo Martínez and Lilia Mónica López Benítez. In total, there were more than 70 provisional suspensions against the reform approved on September 11, and at least two were issued against the acts that the CJF had to carry out to implement it. In the same session, the CJF unanimously approved 26 petitions and requests from the associations of judges that have been on strike since August 19, as well as from the PJF unions. This strike was scheduled to continue, for now, until tomorrow. From the outset, it was resolved that salaries and benefits for the remainder of the year will be paid as approved in the 2024 Expenditure Budget, that is, without immediately applying the order of the constitutional reform that no one can earn more than the President of the Republic. All Judges and Magistrates earn more than Claudia Sheinbaum. In addition, the plenary session of the CJF instructed “to carry out a study of a voluntary retirement program”, in response to the associations’ request that authentic comprehensive reparation be granted to judges who decide that the reform “is incompatible with their life project.” . Regarding the complementary pensions of Judges, the request to eliminate the requirement of already being ratified in their positions to access that benefit will be analyzed. On the other hand, a study will be carried out to determine the form and timing of the settlement payment that Morena included at the last minute in the reform for those who do not agree to participate in the election. Regarding the work stoppage, the longest in the history of the PJF, it was agreed that the CJF will not initiate ex officio actions against any public servant to establish responsibilities, as well as a gradual reduction of the workloads that have accumulated in the last two months, without this period being taken into account for productivity evaluations. There are also several concessions regarding access to the judicial career, professional certifications, basification of positions of trust and payment of overtime, among others.
They warn of imposition of judges
Legislators from the PAN and PRI accused that Morena will have control of the election of Judges, Magistrates and Ministers, since it will decide who appears on the ballots.
Senator Ricardo Anaya (PAN) described as a “joke” the reform of article 500 of the Law of Electoral Institutions and Procedures, which, he said, imposes a veto of the Powers of the Union on the proposals of the Evaluation Committees that will formulate the candidatures. “Each power, that is the President; the majority of Morena, here in the Senate, and so on, are going to approve and veto the people selected by the Evaluation Committee,” lamented the PAN member. The referred article says that the Legislative and Judicial Branches will approve the candidacy proposals with a qualified majority of their members. Approved applications will return to the Evaluation Committees for a final draw of candidates. Deputy Rubén Moreira (PRI) maintained that the veto is a blow to the democracy that was supposed to accompany this reform. “It is not a justice reform nor is it democratic, nor are the people going to choose, perhaps they will select those in power. Morena is going to have the Judges that they consider are best for their causes,” accused the PRI .
