Mexico City.– The coordinator of the Morena deputies, Ricardo Monreal, announced that they will make modifications to the judicial reform to correct the contradiction that exists between articles 94 and 97 of the Constitution regarding the appointment of the Presidency of the Supreme Court of Justice of the Nation.
In an interview, he rejected that the majority legislators had made a mistake, however, he said that they are reviewing the legislative package on justice to resolve the contradiction soon.
“With a reform to the Constitution clarifying that, it will be done,” he said. In accordance with article 94 of the Constitution, modified as part of the judicial reform, the presidency of the Court will fall to the minister who obtains the greatest number of votes in the corresponding election.
However, the legislators “forgot” to reform the paragraph of article 97 of the Constitution, which states that “the plenary session will elect the president” of the Court from among its members.
“These apparent contradictions are going to be resolved, obviously they exist, but the form of election now, with the secondary law, has a very broad procedure to determine the entire process and the regulatory law that was sent yesterday stops a lot, it stops a lot in the procedural aspect of the election of judges, ministers and magistrates,” he commented. Monreal stated that they will soon resolve the contradiction, hence they already have a working group to analyze the entire legislative package regarding the procurement and administration of justice. “We are gathered, we are a Permanent Constituent, we are the reforming power, there is no problem, at any time (a modification proposal) can be presented,” said the Morena coordinator. The deputy rejected that his party is upset with the judicial reform. “Adjustments will be made, but any contradiction or any position that generates uncertainty or lack of certainty will be avoided (). We are very clear, we are not balled up,” he assured.
