The Appeals Center Europe is an independent organization established with the aim of easing the workload of regulators in handling appeals relating to breaches of social media policies. Recently, the center received approval from Ireland’s Coimisiún na Meán authority to be certified under the European Union’s platform regulations, the Digital Services Act (DSA). This recognition allows it to operate as an out-of-court dispute resolution body, offering users of platforms such as Facebook, TikTok and YouTube an alternative to lengthy and expensive legal proceedings.
The tasks and organization of the Appeals Center Europe
Policy violations on social media can have significant consequences for users, with decisions impacting their online presence and activities. The Appeals Center aims to examine these decisions to verify whether they are consistent with the content policies of the platforms, also taking into account human rights principles. Initially, the organization will focus exclusively on disputes originating from the European Union and concerning the three platforms mentioned, with the intention of broadening its scope over time.
The center will consist of a team of experts which will apply a human review to each case, ensuring in-depth analysis by staff specialized in different linguistic and political areas. Thomas Hughes, CEO of the Appeals Centre, said the new dispute resolution landscape in the European Union has enormous potential to give users and communities a voice, allowing them to challenge content decisions on social platforms.
Where is it located and how will it be managed?
Located in Dublin, the Appeals Center expects to receive its first user appeals by the end of the year. To fund its operations, the center will charge fees to social media companies for each case handled, while users will pay a nominal fee, which will be refunded if the verdict is in their favor. With the application of the DSA, which requires individual platforms to adopt moderation and transparency measures, the Appeals Center fits into a broader context of responsibility and protection of user rights in the digital sphere.
