As has happened many times, Nintendo recently attempted to block a company (Modded Hardware) which creates pirated Nintendo hardware, firmware and video games. However, the situation took a strange turn, with the accused – Ryan Daly, alleged owner of the company – deciding to go to courtwithout even the support of a lawyer.
According to the lawsuit, Nintendo offered Daly the opportunity to close the company in March 2024and both parties agreed at the time that Modded Hardware’s business would cease. However, the company continued to operate normally and apparently not even a final warning in May 2024 was successful.
As a result, Nintendo filed a lawsuit in federal court in Seattle, Washington in July, demanding the immediate shutdown of Modded Hardware and the compensation for damages. Daly has denied any wrongdoing in court, mostly responding to the lawsuit’s claims with a “I deny the allegations” or saying he did not have “sufficient information to admit or deny the allegations.”
Nintendo’s words from the lawsuit
“Typically, when a customer buys a console hacked or security circumvention services, the accused pre-installs on the console a series of pirated games ready to be played, including some of Nintendo’s most popular titles such as Super Mario, The Legend of Zelda and Metroid”, reads the lawsuit filed by Nintendo.
“In fact, since i pirate games for Nintendo Switch cannot be used or created without an infringed console and related software and hardware, it is only thanks to products and services such as those sold by the defendant that illegal markets distributing pirated games exist and thrive.”
Lawsuits usually end in favor of Nintendoand this when there are qualified lawyers working against them. We don’t have great confidence that, alone, Ryan Daly can succeed where others have failed. Even PocketPair and its Palworld don’t seem to have much chance.
