The São Paulo Court of Justice and the Procon Foundation will set up the Judicial Center for Conflict Resolution and Citizenship in Consumer Matters (CejusCOM) next Monday, the 7th. The objective of the partnership is to promote reconciliation of demands on consumer relations, mainly the treatment and fight against over-indebtedness.
CejusCom can be contacted by consumers, traders and micro-entrepreneurs from any city in the State to try to reach an agreement with private companies, financial institutions or public service concessionaires.
The service addresses issues of over-indebtedness – when there is a clear impossibility of paying all consumer debts, due and falling due, without compromising the minimum for subsistence.
HOW TO DO
The interested party must seek the service in two ways: – Directly through the consumer at Fundação Procon/SP – Through the Court’s Portal to Combat Over-Indebtedness (https://esaj.tjsp.jus.br/petpgconciliacao/abrirConciliacaoSuperendividamento.do), where You will fill out a form with personal, socioeconomic data, debt information (it can be more than one creditor) and attach proof.
Consumers who have the over-indebted profile will be identified in the screening. They will go through an interview; guidelines (especially the lecture “Debts and Doubts”) and, only after that, will they proceed to renegotiation.
Initially, the intermediation will be carried out by Procon. If there is no success, CejusCOM will schedule a conciliation hearing (in person or online), conducted by conciliators specially trained by the Court.
The agreements will be approved by sentence and will have the effect of judicial enforcement. The coordinating judge of Cejusc Central, Mônica Di Stasi, will be responsible for the unit.
CejusCOM will operate at the João Mendes Júnior Forum (2nd floor), in the center of São Paulo. The initiative has the seal of judge Fernando Antonio Torres Garcia, president of the Court, the coordinator of the TJ’s Permanent Center for Consensual Methods of Conflict Resolution, judge Silvia Rocha, and the director of Procon-SP, Luiz Orsatti Filho.
The Court reported that CejusCom is ‘an integrated and cooperative work, which aims to join the efforts of Procon and the Court with a view to prevention, guidance and consumer education, the renegotiation of their debts and the reinsertion of these agents in the credit market’ .
According to the TJ, the partnership seeks to promote ‘the necessary and urgent rescue of citizenship’.
