Candidate is the only one of the main candidates in the race for Mayor of São Paulo who accesses the platform after being banned; STF set a fine of R$50,000 for anyone using technological subterfuge, such as VPN
The businessman Pablo Marcal (PRTB) is the only one of the main candidates for Mayor of São Paulo that continues to publish in the X (former Twitter) after the suspension of the social network in Brazil. The minister of STF (Supreme Federal Court) Alexandre de Moraes ordered the platform to be blocked on August 30th.
Moraes’ decision was taken after X did not obey the magistrate’s order requesting the presentation of a legal representative in the country. He also set a fine of R$50,000 for anyone using VPN (Virtual Private Network) software and “other technological subterfuges” to access the social network.
THE Power360 found, through the correspondent of this digital newspaper in Portugal, that the candidate Marçal had stopped publishing on X on August 28, 2024, when the platform was taken down. But he returned to using billionaire Elon Musk’s social network on September 23rd. Since then, in none of the publications has the candidate explained how he is accessing the platform.
Marçal’s most recent publication on the former Twitter (until the publication of this post) was at 1:15 pm this Friday (Oct 4, 2024). There are at least 59 posts shared on the candidate’s profile after the platform was suspended.
The other main candidates for mayor of the capital: mayor Ricardo Nunes (MDB), federal deputy Guilherme Boulos (Psol), federal deputy Tabata Amaral (PSB) and presenter José Luiz Datena (PSDB) have not published on the former Twitter since the ban.
THE Power360 He sought out Pablo Marçal’s advice via telephone and messaging app to ask if he would like to comment on the publications in X. Four telephone calls were made. Several text messages were also sent via WhatsApp.
There was no response until the publication of this report. The text will be updated if a statement is sent to this digital newspaper.
X meets STF
OX (former Twitter) said that it paid the outstanding fines with the Brazilian Court and asked the STF (Supreme Federal Court) to unblock the platform this Friday (4.Oct.2024), according to the Power360. The penalty amount is R$28.6 million for non-compliance with court orders.
With the discharge, which has already been filed with the Supreme Court, X regularized its situation in Brazil and awaits a decision to allow it to be unblocked in national territory. In an order, Minister Alexandre de Moraes determined that the payment be verified by the agency’s Judicial Secretariat. Here’s the complete (PDF – 104 kB).
