United States|The trial against Trump for the attempt to overturn the election result was supposed to start in March. However, it was decided to postpone it.
Former president and Republican presidential candidate Donald Trump sought to overturn the 2020 election result by criminal means as a “private individual” and therefore does not enjoy the immunity from prosecution due to the president, special prosecutor Jack Smith writes in a court filing made public on Wednesday.
The 165-page petition also presents new evidence of Trump’s efforts to overturn the election results. The letter was reported by, among others, the news agency AFP.
The trial against Trump for the attempt to overturn the election result was supposed to start in March. However, it was decided to postpone it after Trump’s defense argued that he, as an ex-president, should be protected from charges.
A new twist came in July, when the US Supreme Court decided that the ex-president has broad immunity from prosecution in those cases when criminal suspicions are aimed at official activities. Instead, Trump can be prosecuted as an individual.
In his letter special prosecutor Smith suggests that there are no grounds for moving the trial, because Trump’s criminal intentions to overturn the election result were “basically the actions of a private individual”.
“Defendant [Trump] served as president at the time of the suspected acts, but did not seek to overturn the election result as part of the president’s official duties, but as a candidate and as a private individual,” Special Prosecutor Smith argues.
“Defendant, along with his co-conspirators, launched a series of increasingly desperate attempts to overturn the legitimate election results in the seven states he lost,” Smith continues.
According to the special prosecutor, Trump, among other things, lied to state election officials, falsified votes and tried to get the vice president Mike Pence to prevent confirmation of the election result.
“When all else failed, Trump incited his supporters to take over Congress on January 6, 2021 to prevent the election results from being certified,” the special counsel writes.
According to the letter, Trump had been told on January 6, in the middle of the takeover of Congress, that Vice President Pence had been taken to safety. According to the petition, Trump would have replied to this: “So what? [So what?]”
Special prosecutor Smith writes that Trump was aware that his claims about the falsification of the election results were made up. This was brought to Trump’s attention by his closest aides.
The special prosecutor writes that the White House employee is ready to testify in court about what he heard Trump say to his own family members after the election: “It doesn’t matter if you won or lost the election. I just have to fight like hell.”
Trump recently commented on the special prosecutor’s petition on his own Truth Social account: “The Democrats have harnessed the judiciary against me because they know I WILL WIN.”
A date has not yet been set for the trial of the attempted annulment of the election. However, it will not take place before the November 5th election, where Trump and the Democratic candidate will face each other Terrible Harris.
