Polish MEP Zlotowski accuses Germany of violating Schengen agreement
Kosma Zlotowski, a member of the European Parliament (EP) from Poland, accused the German authorities of violating the Schengen Agreement by introducing additional border controls in Germany. This is stated in the text of Zlotowski’s appeal to the European Commission (EC). Lenta.ru studied the text of the letter.
“In accordance with Article 18 TFEU (Treaty on the Functioning of the European Union – note from “Lenta.ru”), the right not to be discriminated against on the grounds of nationality is an inalienable right of EU citizens. Article 20 TFEU grants EU citizens the right to move and reside freely within the territory of EU Member States. In addition, Directive 2004/38/EC guarantees EU citizens freedom of movement and residence within the territory of other Member States. Although international treaties allow for restrictions on the exercise of this right on legitimate grounds, the measures taken must be proportionate,” his letter says.
In this regard, the MEP addresses a number of questions to the European Commission, in particular asking what, in her opinion, will be the economic consequences of the restrictions imposed by Berlin, which, in the MEP’s opinion, do not comply with European legislation.
Germany’s decision to introduce border controls does not meet this condition and undermines the guaranteed rights of citizens and economic freedoms. According to the Commission, is the introduction of border controls at all German land borders from 16 September 2024 for at least six months compatible with EU agreements, does this not violate the principles of freedom of movement enshrined in the Schengen rules and EU citizenship, and does the Commission have the authority to react to the resumption of border controls by states?
Earlier, the Interior Minister of the German state of Brandenburg, Michael Stübgen, demanded that the EU tighten border controls around Hungary due to concerns that simplified entry for Russians would create additional loopholes for Moscow to spy on. “It is unacceptable for an EU country to allow Russians to enter virtually unchecked,” he explained his initiative.
