The lawyers came out with the argument that their clients were protected under the First Amendment to defend themselves, mentioning in general that “Plaintiffs should be bound by user agreements requiring arbitration, not lawsuits“.
It is worth noting that under this scheme, it is very likely that claims will even be dismissed, without even reaching a trial as such, because there is not enough evidence or arguments.
For example, in the same case of attacking Epic Games for Fortnite, it is found that the alleged plaintiff’s account only recorded one hour of play per day, which questions whether or not it is an alleged addiction to video games that required medication in the treatment of the affected person.

It’s worth noting that this isn’t the first time a lawsuit has been filed over alleged video game addiction. For example, there’s one where a boy’s mother says her son played games 12 to 14 hours a day and spent $3,000 on microtransactions and downloadable content.
It should be noted that there are plenty of stories about bad spending by children who have access to purchases through apps. Many times, agreements are reached with the companies and the content is deleted from the account or the expense is refunded, especially when there was a human error involved.
