The Supreme Court’s opinion is in line with the government, which had been agreed with trade unions and would have less impact on the Union
The Union’s attorney general, Jorge Messias, celebrated the decision of the STF (Supreme Federal Court) this Wednesday (June 12, 2024) that corrects the FGTS (Service Time Guarantee Fund) based on inflation. The opinion is in line with what the government of Luiz Inácio Lula da Silva (PT).
“Today’s decision by the Supreme Court represents a victory for everyone involved in the discussion of the judged action. Workers, those who finance their homes and employees in the construction sector win.”he said.
The trial began in April 2023, but was only resolved now. Part of the delay was due to the federal government, which worked to postpone the trial, so that a proposal more favorable to the Union could be considered by the ministers.
By 7 votes to 4, the Supreme Court decided that the fund income based on the IPCA (Broad Consumer Price Index).
The minister-rapporteur, Roberto Barroso and 3 other magistrates voted for the fund to be adjusted by savings. However, they were defeated by 3 magistrates who voted to correct the IPCA and the 4 who wanted the action to be dismissed – who agreed to opt for the IPCA if they were defeated.
The proposal had been aligned with trade unions and would also represent a smaller impact on public coffers than the correction for savings.
The issue is dear to the government because it impacts the housing sector, especially the Minha Casa, Minha Vida program, which uses FGTS resources to offer financing on more accessible terms.
