The judge of the National Court Francisco de Jorge has agreed this Wednesday to open an oral trial against Luis Rubiales for the crimes of sexual assault and coercion of Jenni Hermoso. In addition to the former president of the Spanish Football Federation (RFEF), the magistrate has also summoned Jorge Vilda, former coach of the women’s team; Albert Luque, former sports director; and Rubén Rivera, former marketing manager, for the coercion of the player, after the non-consensual kiss of the former head of the RFEF.
In his order, the judge has given Rubiales a period of 24 hours to post a bond of 65,000 euros to face any possible civil liabilities to which he could be sentenced for the crime of sexual assault. Due to these events, the former federation president faces a request from the Prosecutor’s Office for two and a half years in prison, one year more than the rest of the accused. The resolution also gives those under investigation a period of ten days to present their defense briefs.
Non-consensual kiss
It should be remembered that it was last January when the judge of the National Court Francisco de Jorge proposed judging Rubiales, considering that the kiss on the player “was not consensual” and that the former leader acted in a “unilateral and surprising” manner. The magistrate, specifically, stated in his resolution that “the pressures to which the player was subjected created” in the women’s national team player “a situation of anxiety and intense stress.”
In addition to Rubiales, the magistrate also proposes sending Luque, Vilda and Rivera to the bench for the subsequent pressure to which the player was subjected to agree to hold a public demonstration stating that the kiss had been consensual. The judge stated that there was “concerted action by the three” defendants agreed upon with Rubiales “to break Hermoso’s will and get him to agree to record a video in which he said that the kiss had been consensual.”
This is not the only case that the former president of the Federation has pending. Rubiales is one of the main actors in the so-called Operation Brodie. The former president was arrested in early April after landing in Madrid from the Dominican Republic, where he had gone to do business, according to his own words. Since then he has been free with charges, accused of the crimes of business corruption, unfair administration, money laundering and membership in a criminal organization. And for this reason he already gave a statement on April 29 before the judge who promoted the investigation, Delia Rodrigo. After attending the Majadahonda courts, where the case is being investigated in collaboration with Anti-Corruption, Judge Rodrigo imposed on Rubiales the obligation to appear in court once a month and to ask the court for permission every time he wants to travel outside of Spain. .
