To manage the estate of their inheritance, and the latter has not handed over his share of the estate’s revenues since 2009, which forced him to cancel the agency and seek the help of a consultant, who arrived at the total of his share of the revenues of the public house and the farm, which is the amount of the claim, while the defendant submitted a request note at the conclusion of which he refused. The lawsuit, because the defendant did not exceed the agency’s limits.

While the report of the expert committee appointed by the court showed that the defendant is the one responsible for managing the estate according to the power of attorney issued by the heirs, to collect the revenues of a public house and a farm, and that the net revenues of the farm during the period from 2009 amounted to 209 thousand and 601 dirhams, and that the plaintiff’s share of those revenues amounted to 28 One thousand and 768 dirhams. As for the revenues of the public housing, it is included in the rental value.

For its part, the court explained in the merits of its ruling that the expert committee reached a conclusion that determined the plaintiff’s share of the farm revenues. As for the public housing, the defendant submitted a declaration stating that the public housing revenues would be delivered at the end of 2023, indicating that it was reassured by what was stated in the expert committee’s report. The court ruled to oblige the defendant to pay the plaintiff an amount of 28 thousand and 768 dirhams, while obligating him to pay the fees and expenses of the lawsuit, and rejected any requests in excess of that.
