Approvals were an effort by the women’s bench; texts include harsher penalties for aggressors and custody for breastfeeding mothers
The Chamber of Deputies approved this Wednesday (Dec 6, 2023) bills that improve legislation on women’s rights and protections. The approvals came after efforts from the women’s bench at Casa Baixa.
Here are the proposals:
SUPPORT FOR WOMEN SUFFERING FROM ALCOHOLISM
The first bill on the agenda approved was the 2,880 of 2023, which creates a psychological and health support program for alcoholic women. The proposal now goes to the Senate.
The rapporteur, deputy Chris Tonietto (PL-RJ), said in an opinion that alcohol abuse was, for years, a “Almost exclusively male problem” and women who drank were seen “in a negative way”.
“No matter how careful and dedicated health professionals are, care for alcoholic patients is designed taking into account the characteristics of male patients”said the congresswoman in the document.
Tonietto states that the proposal “it will come at a good time” to offer “appropriate treatment” to women suffering from the disease.
PREVENTIVE MEASURES FOR VIOLENCE
Afterwards, the plenary approved the bill 5,781 from 2023which allows, in cases of domestic and family violence against women, the judge to order precautionary measures. The proposal also goes to the Upper House.
If approved, the magistrate can, for example, convert flagrant arrest to preventive arrest. Rapporteur, the deputy Soraya Santos (PL-RJ), stated in an opinion that “cases of risk of aggression”it is necessary to “prompt answer” for “avoid irreversible damage to the victim”.
PUNISHMENT OF AGGRESSORS
The 3rd bill approved was the 419 of 2023which changes the “extenuating circumstances” –causes for reduced sentence– and prohibits the prescription of crimes of sexual violence in which the aggressor is, on the date of the cases, under 21 years of age and, on the day of the sentence, over 70 years of age.
The text goes to the Senate. The rapporteur, deputy Adriana Ventura (Novo-SP), said in an opinion that the project is necessary because current legislation “it still has commands that weaken the correct investigation and punishment” of the aggressors.
MATERNAL GUARD
Deputies approved the bill 883 of 2023which amends the Civil Code to “enable unilateral custody” the mother of a newborn while the breastfeeding period lasts, if she makes the request to the Court.
The proposal goes to the Senate. The deputy Iza Arruda (MDB-PE), rapporteur of the text, said in an opinion that the courts “they already peacefully follow the understanding” to grant custody to the baby’s mother. She states, however, that the text is important because, according to her, the “breastfeeding in the first 6 months of life brings numerous benefits” to the baby and mother.
Deputies also approved a bill to increase the penalty for crimes committed against women in the presence of children.
