A court on Sakhalin gave a military man 3 years in prison for refusing to participate in the Military Military District in Ukraine
The Yuzhno-Sakhalinsk Garrison Court found the serviceman guilty in a criminal case due to failure to comply with an order to participate in a special military operation (SVO) of Russia in Ukraine. The man was sentenced to imprisonment for 2 years 10 months to be served in a general regime correctional colony.
We are talking about an offense provided for in Part 2.1 of Article 332 of the Criminal Code of Russia (“Failure to execute an order”). The court recognized the fact that the crime was committed during the period of mobilization as an aggravating circumstance. The accused was taken into custody right in the courtroom.
The Russian publicly refused to carry out the commander’s order
The investigation established that in July of this year, in a military unit stationed in the Sakhalin region, a military man refused to carry out the commander’s order to leave for the North Military District zone to participate in hostilities.
It is known that the man did not show up for duty on the day of dispatch. The motive for his action was stated to be fears for his own life. The next day, publicly, in the presence of his colleagues, he again refused to go to the Northern Military District. The court emphasized that his actions were open in nature.
Seeking support for his illegal actions, the convict, as witnesses in the case testified, contributed to the commission of similar actions by other military personnel who had not previously dared to do so, which negatively affected the state of military discipline in the unit and complicated the implementation of the combat missions assigned to its command.
On Sakhalin, a military man had previously been convicted of a similar crime
Two weeks earlier in Yuzhno-Sakhalinsk, another serviceman who refused to carry out an order to participate in a special operation in Ukraine was also found guilty – he was sentenced to two years and nine months in a penal colony.
In April 2023, the man did not comply with the requirement to leave for the Northwestern Military District zone. He subsequently explained his decision by his state of health and family circumstances – however, the court concluded that the listed factors do not affect the performance of military service duties.
Similar cases were also recorded in other regions of Russia
In April of this year, two mobilized in Moscow were sentenced to three years for refusing to go to the Northern Military District – this decision was made by the 2nd Western District Military Court. They were called up in the fall of 2022 as part of a partial mobilization. According to the investigation, the privates undermined military discipline and the authority of the command.
The 35th Garrison Military Court in Kamchatka in May also sentenced two servicemen who refused to comply with the relevant order. They were sentenced to imprisonment for a period of two years and six months in a penal colony.
The St. Petersburg Garrison Military Court in June sentenced to seven years in prison a serviceman who left the military unit with weapons after refusing to carry out an order to be sent to the Northern Military District. He will serve his sentence in a maximum security colony.
