The green card, as Permanent Residence of the United States is usually known, grants the opportunity to live, work and study in the country. What you may not have known is that it is possible to request it from abroad, in a process known as “consular procedure“.
To apply for a green card in this way, you must meet the eligibility criteria for the immigrant category you wish to apply for. You must have an approved immigrant petition from a U.S. citizen or lawful permanent resident and pay applicable application fees..
How to apply for the Green Card from abroad?
Once you have met the requirements, you can apply for an immigrant visa at a U.S. embassy or consulate in your home country. According to United States Citizenship and Immigration Servicess (Uscis for its acronym in English), the steps to apply for a Green Card from abroad are:
- Determine your eligibility and basis for immigration: The first thing is to make sure you are eligible to apply for a Permanent Resident Card. Eligibility may be derived from a petition filed on your behalf by a U.S. family member or employer. Other avenues include refugee or asylum status, as well as special provisions.
- File the immigrant petition: Once you determine your eligibility, you must file an immigrant petition. This usually involves one person filing the petition on their behalf.
- Wait for the decision on your request– Once the petition is filed, Uscis will notify the petitioner of the decision. If approved and if you are outside the United States (or choose to process your immigrant visa from abroad), Uscis will send your approved petition to the Department of State’s National Visa Center (NVC), where it will remain until a visa number is available.
- Wait for notification from the National Visa Center (NVC): The NVC is responsible for collecting visa application fees and managing supporting documentation. It will also notify the petitioner and beneficiary of the receipt of the visa petition and when the immigrant visa will be available soon. Additionally, it will provide information about immigrant visa processing fees and required documentation.
- Attend the appointment– Once the visa is available or the priority date is current, the consular office will schedule an interview. During this appointment, the consular officer will evaluate his eligibility to receive an immigrant visa.
- Notify the National Visa Center of changes– You must keep the NVC informed in case of changes in your situation, such as a new address, turning 21, changing your marital status, among others. This is important, as such changes may affect your eligibility or visa availability.
- After your visa approval: If an immigrant visa is granted, the consular officer will provide you with an information packet, also known as the “Visa Packet.” Don’t open it. After arriving in the United States, you must deliver this package to the Customs and Border Protection officer at the port of entry. Once admitted by the customs officer, he will obtain permanent resident status and will be able to live and work permanently in the United States.
- Receive your Permanent Resident Card– If you paid the Uscis Immigrant Fee, you will receive your Permanent Resident Card in the mail within 90 days after your arrival in the US. If you do not receive it within that period, contact the Uscis Contact Center or visit the e-Request–Non-Delivery of Card page. If you did not pay the fee prior to arriving in the United States, you must do so before Uscis sends you the Permanent Resident Card.
