Lawyer was director of Aneel from August 2018 to August 2022; The post is equivalent to the post of Deputy Minister
The lawyer Efrain Pereira da Cruzwho was director of Aneel (National Electric Energy Agency) from August 2018 to August 2022, will be the executive secretary of the MME (Ministry of Mines and Energy). In practice, this position is the equivalent of deputy minister. The position has not yet been filled.
In addition to the role he will have at the MME, Efraim is also on the list of nominees to join Petrobras’ Board of Directors.
Efraim’s name was not a consensus within the government. The Minister of Mines and Energy, Alexandre Silveira, banked the nomination. The president Luiz Inacio Lula da Silva heard the arguments and gave the go-ahead.
WHO IS EFRAIN CRUZ
In 2022, Efrain Cruz was the favorite of several senators for the position of general director of Aneel, but ended up being passed over by decision of the then Minister of Mines and Energy, Bento de Albuquerque. The option for the position at the time was Sandoval Feitosa, whose name was defended by Senator Ciro Nogueira (PP-PI), then chief minister of the Civil House of Jair Bolsonaro (PL).
As director of Aneel, Efrain Cruz was notable for his independence from the Bolsonaro government, especially in relation to the heads of Mines and Energy –Bento Albuquerque It is Adolfo Sachsida.
In discussions around the call “covid account”, created by the federal government to transfer to consumers the revenue losses experienced by distributors during the pandemic, Efrain Cruz took a stand against the positions of the Ministry of Mines and Energy (during Bento Albuquerque’s management) and the then director general of Aneel, André Pepitone, from the technical areas and the agency’s Attorney. He opened a divergence and formed a majority in favor of the decision that reduced costs to be borne by consumers.
Also weighing in favor of Efrain Cruz is his action to overcome the crisis of the so-called GSF (from the English expression “generation scaling factor”). The GSF is a calculation that measures risk by analyzing the relationship between the volume of energy produced by a plant and the physical guarantee (for example, the volume of water stored by a hydroelectric plant) that the undertaking actually has. The calculation on the GSF dragged on for years in court and jeopardized the functioning of the market. Efrain Cruz acted to pacify the process.
Efrain Cruz also worked on reviewing the regulatory framework for distributed generation. He waited for the decision of the National Congress on the subject before proceeding with the proposed regulatory solution at Aneel, which was met with strong criticism and resistance from entities representing solar and wind sources.
