SAO PAULO (Reuters) – Americanas reported on Wednesday that the Rio de Janeiro Court of Justice suspended the day before the blockade of approximately 1.2 billion reais held by BTG Pactual.
The blockage occurred after the investment bank obtained a writ of mandamus on the 18th against a decision that, among other matters, granted the retailer the right to recover amounts offset by creditors.
Americanas had obtained a decision on January 13 that protected it from creditors.
The company filed for bankruptcy last week, citing debts of around 43 billion reais, eight days after revealing an accounting deficit of 20 billion reais.
This Wednesday, citing the new decision, Americanas said that the amount must be released to the retailer and used only for the company’s core activity, “under the direct management of the company’s judicial administrator until the judgment of the merits of the writ of mandamus filed by Banco BTG”.
Americanas added that the judgment of the 4th Business Court of the Judicial District of the Capital of Rio de Janeiro also granted the day before the “seizure/seizure of the values claimed by the company and which had been blocked by Safra and Votorantim Banks”.
“With the decision, the blocked money that is arrested/kidnapped will again become the property of the company, but must be kept in judicial deposit.”
