Judge Raquel Vasconcelos Alves de Lima, deputy of the 2nd Federal Criminal Court of Belo Horizonte, accepted the complaint of the Federal Public Ministry (MPF) against executives and employees of Vale and Tüv Süd accused of the deaths caused after the rupture of the dam of Brumadinho. The decision places in the dock 16 people and two companies that were initially denounced by the state MP.
Following a decision by the Federal Supreme Court (STF), the case was referred to the Federal Court in Minas Gerais. The day before yesterday, the State Attorney’s Office ratified the charge, which describes not only crimes of aggravated homicide, 270 times, but also crimes against fauna and flora, as well as the crime of pollution. The MPF can still add to the complaint to “add or replace the accused or criminal facts”.
Defense
Vale, on the other hand, reaffirms “the respect for the families directly and indirectly impacted by the rupture of Dam 1, in Brumadinho, and remains committed to repairing and compensating for the damages”. The company reinforces that it has always based its activities on safety assumptions. Upon receipt of the complaint, lawyer David Rechulski is responsible for the legal defense of the company.
“Considering the premise that the first focus was the formal receipt of the complaint in order to avoid the prescription of environmental crimes, it is not surprising that a complaint of 477 pages, more than 80 volumes, in a total of more than 24 thousand pages, has been received in less than 24 hours. There is therefore nothing more to comment on”, says Vale. Tüv Süd will not comment on the decision.
