Almost five years after the violent death of the Dutch film editor Wouter van Luijn in Mallorca, the trial against two suspects will take place in a few months. This was determined by the judge during a preliminary hearing yesterday.
Van Luijn died in the summer of 2018 at the age of 34 after he was attacked by several men on the street in a remote neighborhood at night. The Spanish OM has only been able to identify one of the perpetrators and is demanding eight years in prison against him for wrongful death and theft with violence, the newspaper reports today Diario de Majorca.
Van Luijn’s father, with whom he was on holiday that summer, is demanding as a private prosecutor – in Spanish law others besides the Public Prosecutor can also act as prosecutors – 27 years in prison for murder. He also accuses a second person of complicity, against whom he demands almost 6 years in prison.
Slum
On the night of July 13, Van Luijn arrived in a taxi with two other men at the slum, Son Banya, just outside Palma de Mallorca. There he was attacked by a group of boys, including the defendant Adrián HE, who robbed him of 800 euros. The blows Van Luijn received in the face knocked him unconscious. Adrián HE’s two companions fled in panic in the taxi, while the defendant delivered the seriously injured Dutchman to a hospital in a car.
The man who accompanied him is being sued by Van Luijn’s family for complicity, and because the brusque driving would have aggravated the filmmaker’s condition, according to Diario de Majorca. In the hospital, the doctors could no longer save Van Luijn’s life: he had a cerebral hemorrhage.
Manslaughter
The Public Prosecution Service charges culpable homicide because, according to the forensic report, the blows alone would not have been enough to cause death. Van Luijn would already have had a problem with a dilated blood vessel, an aneurysm. Van Luijn’s father disputes that, according to the Spanish newspaper, and says that there is no medical evidence for this. An exact date for the start of the trial has not yet been announced. The two defendants are currently in custody on other charges.
