TRE de São Paulo considered that the presenter’s post on a social network in early June violated electoral law
Presenter José Luiz Datena, affiliated with the PSC, was sentenced to pay a fine of R$5,000 for early electoral propaganda in a lawsuit filed by the MPE-SP (Public Electoral Ministry of São Paulo) on June 29.
The TRE (Regional Electoral Court) of São Paulo upheld the case on Thursday (14.Jul.2022).
The action was motivated by a publication by Datena on her Facebook profile on June 4th. In the video, the presenter said he intended to run for the Senate on the ticket of former Minister of Infrastructure Tarcísio de Freitas, pre-candidate for the Palácio dos Bandeirantes by the Republicans.
“We will be elected together with a vote you [eleitor] will give us. [A votação] will be fantastic, and this is a message mainly to alleged allies of the president [Jair Bolsonaro], who appear to be campaigning exactly for the opponent or opponents. Thank you very much, good morning, with God and health,” Datena said in the video, which was later deleted.
On the same day, he even posted another short video in which he claims to continue “leading all voting intent polls for the Senate” in the state.
“It means that today the people of São Paulo would elect me their senator. But politics and some politicians keep rejecting me. So, really, I prefer to continue representing the people, as I always did.”, said Datena at the time.
The host withdrew from running for Senate at the end of June during the Brazil Urgenta program that controls the band, although it led the race with 25% of voting intentions in a survey carried out by Paraná Pesquisas from June 27th to 30th. The survey is registered with the TSE (Superior Electoral Court) under the number SP-08345/2022.
Earlier this week, Datena announced that he had been diagnosed with Covid-19. He had only mild symptoms of the disease.
