Al-Ain Court of Appeal upheld a ruling of the Court of First Instance, which obligated a doctor and a medical center to pay a young man 100,000 dirhams, as compensation for negligence and failure to conduct medical examinations, to determine the extent of the injury suffered by the young man while playing football, which led to physical complications, Not exercising for six months.
In detail, a young man filed a lawsuit before the Al Ain Court of First Instance, demanding that a medical center and the treating doctor pay him, in solidarity, 150 thousand dirhams, material and moral compensation, noting that he went to the emergency department of the medical center, after suffering a foot injury, and the doctor neglected to treat him, what This led to the deformity of the foot, and the inability of the young man to walk normally.
He noted that the Medical Liability Committee proved the error of the treating physician, and caused the resulting damage, due to negligence and incompatibility of health care, and submitted a copy of the report of the Medical Liability Committee, and a copy of a medical report issued by a hospital.
The defense of the medical center submitted a memorandum requesting the rejection of the case, while the doctor stated that he was dismissed from work, and this is sufficient for what happened to him, while the defense present with the young man submitted a request to compel the defendants to jointly pay him compensation for the material, moral and psychological damages he sustained, amounting to 150 thousand dirhams.
The Court of First Instance ordered the defendants to pay the complainant a compelling compensation for all material and moral damages, in the amount of 100,000 dirhams, and obligated them to pay the expenses and fees of the case.
This court did not obtain acceptance from the defendants, so they appealed the ruling, demanding that the case be dismissed. Al-Ain Court of Appeal confirmed in its ruling that the evidence from the papers is the psychological and physical suffering of the respondent, and the method of treatment he underwent at the medical center was the cause of the aforementioned damage, which had health effects, and ruled to reject the appeal, and uphold the ruling of the Court of First Instance.
